Welcome to www.easybmv.com (the “Website”), operated by GovSoft, LLC (“GovSoft,” “we,” “us,” or “our”). By accessing or using this Website and the services provided through it (collectively, the “Services”), you agree to comply with and be bound by these Terms of Service (“Terms”). Please read these Terms carefully. If you do not agree to these Terms, you may not use the Website or Services.
1. Acceptance of Terms
By accessing or using EasyBMV, you agree to these Terms and confirm you are at least 18 years of age. If you represent an organization, you confirm that you are authorized to bind the organization to these Terms.
2. Definition of EasyBMV
“EasyBMV” refers to GovSoft’s digital platform and associated services that allow individuals and private companies in Ohio to obtain electronic vehicle registrations through a secure, cloud-based, and autonomous system. EasyBMV is designed to streamline registration processes.
3. Description of Services
EasyBMV is a platform enabling users to access electronic vehicle registration services. Through a user-friendly, remote interface, EasyBMV provides efficient and compliant registration options for eligible users in Ohio (“EasyBMV Services”).
4. Account Registration
To use the Services, you may be required to register for an account. You agree to provide accurate and complete information during registration and to update your information as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
5. Privacy and Security
EasyBMV implements measures to protect user data. We are committed to safeguarding your information and will not share personal data with unauthorized third parties. Our Privacy Policy governs how we collect, use, and share information. By using our Services, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.
6. SMS/Text Messaging Terms of Service
By providing your mobile phone number and opting in to receive text messages from EasyBMV, you agree to the following terms. EasyBMV offers three categories of text messages, each requiring separate consent where indicated.
6.1 Account Verification Messages (OTP)
When you check the verification SMS consent box during account registration, you agree to receive one-time passcode (OTP) and account verification text messages from EasyBMV. These messages are used to verify your identity during login, confirm your account, and protect your account security. Message frequency varies based on your login and verification activity. This consent is required to use EasyBMV’s two-factor authentication feature.
6.2 Account Status and Notification Messages
When you separately check the account notifications consent box during account registration, you agree to receive account status notifications via text message. These include alerts about your vehicle registration processing status, document readiness updates, payment and billing confirmations, registration renewal reminders, and requests for additional documentation. Message frequency varies based on your account activity. This consent is optional and is not required to use EasyBMV.
6.3 Promotional Messages (Optional)
If you separately opt in by checking the optional marketing consent box, you agree to receive promotional and informational text messages from EasyBMV. These may include special offers and discounts, service updates and new feature announcements, tips and educational content related to vehicle registration, and surveys or feedback requests. Message frequency varies but will not exceed 10 messages per month. Consent to receive promotional messages is not required as a condition of purchasing any goods or services from EasyBMV.
6.4 General SMS Terms
• Message and data rates may apply. Your carrier’s standard messaging rates apply to all text messages sent and received.
• Carriers are not liable for delayed or undelivered messages.
• Opt-Out: You may opt out of text messages at any time by texting STOP to any message you receive from EasyBMV. After texting STOP, you will receive a single confirmation message and no further texts will be sent. Opting out of all messages may affect your ability to use two-factor authentication. To opt out of promotional messages only, text STOP PROMO.
• Help: For assistance, text HELP to any message you receive from EasyBMV, or contact us at hello@easybmv.com for email support.
• Supported carriers include, but are not limited to, AT&T, T-Mobile, Verizon, Sprint, and most major US carriers.
• Privacy: Your phone number and opt-in data will not be shared with third parties for marketing purposes. See our Privacy Policy for details on how we handle your information.
By opting in, you acknowledge that you have read and agree to these SMS Terms of Service.
7. Acceptable Use
You agree to use EasyBMV only for lawful purposes and in compliance with all applicable laws and regulations. You will not:
• Engage in any unauthorized access, data mining, or scraping activities.
• Use the Services to transmit malware, viruses, or harmful software.
• Attempt to circumvent or compromise our cybersecurity measures.
8. Intellectual Property
All content, design elements, and functionality on the Website and EasyBMV Services, including but not limited to logos, text, software, and graphics, are owned by or licensed to GovSoft and are protected by copyright, trademark, and other laws. Unauthorized use of this content is prohibited.
9. Third-Party Services and Links
The Website may contain links to third-party websites or services not owned or controlled by GovSoft. GovSoft is not responsible for the content, policies, or practices of these third parties. Accessing these websites or services is at your own risk.
10. Limitation of Liability
To the fullest extent permitted by law, GovSoft, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to the use of EasyBMV, including but not limited to loss of revenue, profits, or data.
11. Disclaimer of Warranties
GovSoft provides the Services “as is” and “as available,” without warranty of any kind, express or implied. We do not guarantee that the Services will be uninterrupted, secure, or error-free. GovSoft disclaims any warranties of merchantability, fitness for a particular purpose, or non-infringement.
12. Indemnification
You agree to indemnify and hold harmless GovSoft, its officers, employees, and affiliates from any claims, damages, or expenses arising out of or related to your use of the Services, violation of these Terms, or infringement of any third-party rights.
13. Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to its conflict of laws principles. Any dispute arising under or in connection with these Terms shall be resolved in the state or federal courts located in Ohio.
14. Changes to Terms
GovSoft reserves the right to modify or update these Terms at any time. We will provide notice of changes by posting the revised Terms on the Website. Continued use of the Services after any modification constitutes acceptance of the new Terms.
